QR CODEBLU EMERGENCY TERMS & CONDITIONS

1. Nature of Service

QR CODEBLU EMERGENCY is a 24/7 QR Code Activated Emergency Coordination Service. It caters for motorcyclists, pillions and cyclists. QR CODEBLU EMERGENCY coordinates rapid emergency response services through its affiliated call centre. Utilising the services of tried and tested emergency service providers.

2. Membership Activation

Membership only becomes active once:

  • Onboarding has been completed in full
  • All required information has been provided
  • Payment has been received by QR CODEBLU EMERGENCY
  • A valid QR CODEBLU EMERGENCY membership number and QR Code has been issued

No services will be rendered before membership activation.

3. QR Code Display Requirement

The member's QR Code must be clearly displayed and visible on:

  • The registered motorcycle, scooter, bicycle or e-bike
  • The member's helmet

Failure to correctly display the QR Code may result in delays or an inability to activate services. QR CODEBLU EMERGENCY reserves the right to decline assistance where the QR Code Sticker is damaged, not visible, unreadable or not linked to an active membership.

4. Emergency Activation

Upon scanning a valid QR Code:

  • The Emergency Coordination Centre is alerted
  • They will Contact the Designated Emergency
  • They will Coordinate the Emergency Services
  • They will Coordinate the Hospital Admission Assistance
  • They will Arrange the Motorbike or Bicycle Recovery and Safeguarding where applicable

All services remain subject to availability, location and operational limitations.

5. Member Responsibilities

Members warrant that:

  • All information supplied is accurate and complete
  • Medical information is updated when changes occur
  • Emergency contact information remains current
  • Membership fees are paid when due
  • They are in possession of a valid driver's licence

Weekender Plus Membership: Coverage only applies during designated weekend periods. Incidents occurring outside the Weekender Plus coverage period are not covered. Additionally, QR CODEBLU EMERGENCY accepts no responsibility for incorrect, incomplete or outdated information.

6. Membership Packages

Weekender Plus Membership: Coverage only applies during designated weekend periods. Incidents occurring outside the Weekender Plus coverage period are not covered.

Elite Membership: Coverage applies every day of the week.

QR CODEBLU EMERGENCY may, at its sole discretion, offer assistance outside the designated period subject to immediate payment of the applicable Elite Membership fee or annual upgrade fee.

7. Exclusions

QR CODEBLU EMERGENCY™ does not provide:

  • Medical aid cover
  • Medical insurance
  • Vehicle insurance
  • Roadside assistance
  • Vehicle repairs
  • Replacement motorcycles or bicycles
  • Guaranteed recovery services
  • Guaranteed emergency response times
  • Guaranteed Hospital admission
  • No cover shall apply in respect of any motorsport, racing, competitive or timed event or activity of any nature whatsoever, including any such activities involving motorcycles or bicycles.

8. Limitation of Liability

8. DISCLAIMER AND LIMITATION OF LIABILITY

8.1 Subject to the provisions of sections 43(5) and 43(6) of the ECT Act, if applicable, and as far as allowed by law, QR CodeBlu Emergency (including its owners, directors, employees, suppliers, Internet service providers, partners, affiliates and agents) shall not be liable for any damage, loss or liability of any nature incurred by whomever and resulting from:

8.1.1 Access to the QR CodeBlu Emergency website;
8.1.2 Access to websites linked to the QR CodeBlu Emergency website;
8.1.3 Inability to access websites linked to the QR CodeBlu Emergency website;
8.1.4 Content available on the QR CodeBlu Emergency website;
8.1.5 Services available from the QR CodeBlu Emergency website;
8.1.6 Downloads and use of content from the QR CodeBlu Emergency website; or
8.1.7 Any other reason not directly related to QR CodeBlu Emergency’s gross negligence.

8.2 The QR CodeBlu Emergency website is supplied on an "as is" basis and has not been compiled to meet the User's individual requirements. It is the responsibility of the User to satisfy himself or herself, prior to entering into this agreement with QR CodeBlu Emergency, that the content available from and through the QR CodeBlu Emergency website meets the User's individual requirements and is compatible with the User's computer hardware and/or software;

8.3 QR CodeBlu Emergency does not make any warranties or representations that content and services available from the QR CodeBlu Emergency website will in all cases be true, correct or free from any errors. QR CodeBlu Emergency shall take all reasonable steps to ensure the quality and accuracy of content available from the QR CodeBlu Emergency website and encourage Users to report incorrect and untrue information subject to the right of QR CodeBlu Emergency to rely on its free expression rights and determine, in its sole and absolute discretion, the contents of this website; and

8.4 QR CodeBlu Emergency does not make any warranties or representations that the QR CodeBlu Emergency website shall be available at all times. Users acknowledge that the QR CodeBlu Emergency website may be unavailable due to updates or other causes beyond the reasonable control of QR CodeBlu Emergency, including, but not limited to virus infection, unauthorised access, power failure or other "acts of God."

9. POPIA Consent

The member consents to the collection, processing, storage and sharing of personal and special personal information, including medical information, where necessary to provide QR CODEBLU EMERGENCY coordination services.

10. Debit Order Authority

Where monthly membership is selected, the member authorises QR CODEBLU EMERGENCY to process recurring debit order payments. Failure of three consecutive payment attempts may result in automatic suspension or termination of membership.

11. Automatic Renewal

Memberships automatically renew unless cancelled in accordance with the cancellation provisions.

12. Cancellation

Members may cancel membership by providing written notice. No refunds will be provided for partially used membership periods unless required by law.

13. Cooling-Off Period

Members shall enjoy any cooling-off rights afforded under applicable South African consumer legislation.

14. Rider Assumption of Risk

Motorcycling and cycling are inherently dangerous activities. Members acknowledge and accept all risks associated with participation in such activities.

15. Medical Disclaimer

QR CODEBLU EMERGENCY™ does not provide medical advice, diagnosis or treatment. Members must seek professional medical care where required.

16. No Guarantee

QR CODEBLU EMERGENCY™ cannot and does not guarantee:

  • Rescue
  • Emergency response
  • Hospital admission
  • Recovery of property
  • Medical outcomes
  • Survival

QR CODEBLU EMERGENCY acts merely as a coordinator of the above services to the best of our ability.

17. Force Majeure

QR CODEBLU EMERGENCY™ shall not be liable for failure to perform due to events beyond its reasonable control.

18. Dispute Resolution

Any dispute arising from membership shall first be referred to mediation and, failing resolution, arbitration in South Africa.

19. Governing Law

These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

20. Electronic Communications

Members consent to receiving notices, statements, alerts and communications electronically.

21. Entire Agreement And Severability

21.1 These terms and conditions constitute the entire agreement between QR CodeBlu Emergency and the User and shall take precedence over any disclaimers and/or legal notices attached to any communications and/or postings received by QR CodeBlu Emergency from the User;

21.2 Any failure by QR CodeBlu Emergency to exercise or enforce any right or provision shall in no way constitute a waiver of such right or provision; and

21.3 In the event that any term or condition detailed herein is found unenforceable or invalid for any reason, such term(s) or condition(s) shall be severable from the remaining terms and conditions. The remaining terms and conditions shall remain enforceable and applicable.

22. Agreement In Terms of Section 21 of The ECT Act

User and QR CodeBlu Emergency agree that the User shall be bound to these terms and conditions and such agreement is concluded in Claremont (South Africa) at the time the User enters the QR CodeBlu Emergency website for the first time;

23. Legal Costs

QR CodeBlu Emergency shall not be liable for costs incurred by Users to obtain professional advice relating to these terms and conditions.

1. What is QR CODEBLU EMERGENCY™?

QR CODEBLU EMERGENCY is South Africa's first and only QR Code Activated Dedicated Emergency Coordination Service for Motorcyclists, their Pillions and Cyclists alike. In the event of an Accident or Medical Emergency, a simple scan of your personal QR Code activates our 24/7 Emergency Coordination Centre, which coordinates assistance, contacts your dedicated emergency contact, assists with ambulance and hospital admissions and arranges vehicle recovery where applicable.

2. How does QR CODEBLU EMERGENCY™ work?

Each member receives a unique QR CODE linked to their emergency information.

If you are involved in an accident, either You, a Fellow Rider, a Bystander, First Responder, Traffic Officer, Paramedic or Medical Professional simply scans your QR Code. This instantly alerts the QR CODEBLU EMERGENCY Coordination Centre who will:

  • Coordinate emergency assistance
  • Notify your Designated Emergency Contact
  • Provide critical information to responders
  • Assist with hospital admissions
  • Coordinate vehicle recovery and safeguarding
  • Keep your loved ones updated

3. Where should I place my QR Code Sticker?

  • For maximum effectiveness, we recommend affixing one to either side of your helmet, left and right.
  • Your motorcycle or bicycle has four stickers, two on the front and two on the back, left and right. You are trying to ensure easy awareness and visibility.
  • Top box: We recommend affixing one on either side.

The more Visible your QR Code is, the quicker assistance can be activated.

4. Who can join QR CODEBLU EMERGENCY™?

QR CODEBLU EMERGENCY is available to:

  • Motorcycle Riders
  • Pillion Passengers
  • Road Cyclists
  • Mountain Bikers
  • Recreational Cyclists
  • Commuter Cyclists
  • Adventure Riders

5. Can my pillion passenger also be covered?

Yes.

Each pillion passenger will need to join QR CODEBLU EMERGENCY in their own right and as such will receive a personalised QR Code Sticker, as emergency information differs from person to person.

6. I'm a tourist visiting South Africa. Can I join for the duration of my stay?

Absolutely.

QR CODEBLU EMERGENCY welcomes international visitors Travelling in South Africa. Temporary memberships can be arranged for the duration of your visit, ensuring access to emergency coordination services while you are Travelling.

7. What happens if I am unconscious after an accident?

This is exactly why QR CODEBLU EMERGENCY exists.

If you are unable to communicate, your personalised QR Code allows anyone else present to activate and initiate the Emergency Coordination Services by initiating assistance on your behalf. QR CODEBLU EMERGENCY can notify your loved ones or Designated Emergency Contact, provide critical information and coordinate support when you cannot speak for yourself.

8. What information is stored on my QR Code?

The QR Code does not publicly display your personal information, however, it securely links to your personal information stored on QR CODEBLU EMERGENCY's database such as:

  • Name
  • Emergency contacts
  • Medical aid details
  • Allergies
  • Medical conditions
  • Blood type
  • Other emergency information provided by you.

All information is managed in accordance with POPIA.

9. What happens to my Motorcycle or Bicycle in the event of an accident?

Once your QR Code is scanned and activated, vehicle recovery and transport to a secure location is coordinated simultaneously.

Your Motorcycle or Bicycle will be transported to a secure storage location until your family, insurer or nominated representative provides further instructions.

10. Does QR CODEBLU EMERGENCY™ provide medical aid or insurance?

No.

QR CODEBLU EMERGENCY is neither a Medical Aid, Insurance or Ambulance Service Company.

QR CODEBLU EMERGENCY is an Emergency Coordination Service that activates via the QR Code, our dedicated 24/7 Emergency Call Centre. This call centre then manages and coordinates the Emergency Service Responders ensuring a smooth and trouble-free recovery initiation

11. Does QR CODEBLU EMERGENCY™ work nationwide?

Yes.

QR CODEBLU EMERGENCY operates across South Africa through its emergency coordination network and service providers in major centres and surrounding areas.

Coverage may vary in extremely remote locations.

12. How quickly is my emergency contact notified?

Immediately upon activation of the QR CODEBLU EMERGENCY process.

The QR CODEBLU EMERGENCY Coordination Centre will notify your Designated Emergency Contact and keep them updated throughout the process where possible.

13. What if my phone is damaged or inaccessible?

QR CODEBLU EMERGENCY does not rely on your phone.

Anyone who can access your QR Code can activate the Emergency/Recovery process.

14. What happens after I join?

Once payment and your Onboarding Form has been received:

  • Your membership is activated
  • Your emergency information is uploaded
  • Your unique QR CODEBLU EMERGENCY QR Code is generated
  • Your QR Code sticker pack is dispatched to you.

Members are encouraged to place the stickers on their helmets and Motorcycles/Bicycles immediately upon receipt.

15. What is the difference between Weekender Plus and Elite?

Weekender Plus Membership:
Cover on Saturdays and Sundays only, ideal for recreational riders and enthusiasts.

Elite Membership:
Covers 7 days per week 24 hours per day. Ideal for daily commuters and regular riders.

16. Is my information secure?

Yes.

QR CODEBLU EMERGENCY takes privacy seriously and complies with the Protection of Personal Information Act (POPIA). Your information is stored securely and is only accessed when required during an emergency activation. At this stage the relevant information could be shared if need be to secure your most beneficial recovery.

17. What if nobody scans my QR Code?

We encourage QR CODEBLU EMERGENCY members to place their QR Code Stickers prominently on both their helmet and motorcycle/bicycle.

Emergency personnel, bystanders and fellow riders are increasingly familiar with Emergency systems, making visibility critical to rapid activation.

18. Why do I need QR CODEBLU EMERGENCY™?

Because accidents happen without warning.
